This Terms of Use document (“Terms”) is published in accordance with Rule 3(1) of the Information Technology (Intermediary Guidelines) Rules, 2011, and the Digital Personal Data Protection Act, 2023, which require the publishing of rules, regulations, privacy policy, and Terms of Use for access to or usage of www.dreamhousemakerz.com (“Website”) and related mobile application(s) (together “Platform”).

The Platform is owned and operated by Dream House Makerz, a company incorporated under the Companies Act, 1956, with its registered office at 506, Fortune Aura, Gurmeet Nagar, Bhanwarkua Road, Indore, India (“Company”, “we”, “us”, “our”).

By accessing, browsing, registering, or otherwise using the Platform, you (“User”, “you”, “your”, “Client”) agree to comply with and be bound by these Terms of Use and all applicable laws. If you do not agree with these Terms, you must not use this Platform or avail of our Services.

1. Scope of Services

Dream House Makerz provides professional architectural and design-related services, including but not limited to online elevations, floor plans, interior design, 3D visualization, structural concepts, and space planning.
All Services are offered online, and designs are prepared based on information, inputs, and specifications provided by the Client.
The accuracy of Services depends directly on the correctness and completeness of data submitted by the Client.

2. Eligibility

Use of the Platform is available only to persons who are 18 years of age or older and are legally capable of entering into binding contracts under Indian law.
If you are accessing or using the Platform on behalf of a company, partnership, or other entity, you represent and warrant that you have the authority to bind such entity to these Terms.

3. User Responsibilities

You agree to provide accurate, true, and complete information while registering and availing Services.
You are solely responsible for ensuring that your project complies with applicable building codes, municipal regulations, local laws, and approvals.
You acknowledge that our Services are advisory and conceptual in nature, and you must consult with licensed local architects, engineers, or authorities before implementation.

4. Intellectual Property Rights

All designs, layouts, graphics, and content available on the Platform or delivered to Clients are the intellectual property of Dream House Makerz.
You are granted a limited, non-exclusive, non-transferable license to use the delivered designs solely for your personal property and project.
You may not reproduce, distribute, display, or exploit the content for commercial purposes without our prior written consent.

5. Payment Terms

Fees for Services are to be paid upfront or in installments, as agreed at the time of placing an order.
Services will commence only after confirmation of payment.
Failure to make payments may result in withholding or termination of Services.

6. Revisions and Modifications

Each package includes a fixed number of design revisions. Additional revisions beyond the agreed limit will be chargeable.
Revisions must be requested within the timeline specified; delayed requests may not be entertained.

7. Prohibited Uses

For any unlawful, illegal, or fraudulent purposes.
To upload or transmit harmful code, malware, or offensive content.
To misrepresent identity, impersonate another person, or mislead the Company.

8. Limitation of Liability

Services are delivered “as is” without warranties of any kind, either express or implied.

We are not liable for:
- Construction errors, structural issues, or site-specific challenges.
- Delays caused by inaccurate information from the Client.
- Regulatory rejections by local authorities.
Our maximum liability under any claim shall not exceed the fees paid by the Client for the specific Service.

9. Indemnity

You agree to indemnify and hold harmless Dream House Makerz, its directors, officers, employees, and affiliates against any claims, damages, losses, or liabilities arising out of:

Your breach of these Terms.
Misuse of Services or Platform.
Violation of applicable laws or third-party rights.

10. Termination

We may suspend or terminate your access if you violate these Terms or misuse the Platform.
Upon termination, your license to use our Services immediately ceases.

11. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of India.
All disputes shall be subject to the exclusive jurisdiction of the courts in Indore, Madhya Pradesh.
